They entered what is known in the legal world as \u2018public domain\u2019.\u201d<span class=\"Apple-converted-space\">  <\/span>MakerBot, the creator and manager of Thingiverse, <span class=\"s2\">responded<\/span> by saying that \u201c[w]hen Thingiverse users upload Things to Thingiverse, they choose the license under which they make their designs available, which can include [Creative Commons] licenses.\u201d <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Loubie quickly spread her story on the internet and supporters rallied to her call.<span class=\"Apple-converted-space\">  <\/span>Within weeks, either eBay or just3Dprint itself removed all of the objects 3D printed from Loubie\u2019s digital blueprints.<span class=\"Apple-converted-space\">  <\/span>The controversy, while at least temporarily revolved, raises several important IP issues that 3D model designers should think about before uploading digital blueprints to the internet.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">While Loubie\u2019s digital blueprint and objects printed from it, which sparked the firestorm, may be copyrightable, this is not automatically true of all digital blueprints and the things printed from them.<span class=\"Apple-converted-space\">  <\/span>3D printed objects are copyrightable only if they are artistic or creative in some way and are not purely functional.<span class=\"Apple-converted-space\">  <\/span>The same is true of digital blueprints, as long as they contain some human creativity and are not the result of a 3D scan that has not been modified in any way.<span class=\"Apple-converted-space\">  <\/span>In Loubie\u2019s case, her design appears to have been her own creation of a dragon perched on a pedestal, and therefore the digital blueprint was probably copyrightable and objects printed from it are called \u201cderivative works\u201d under the copyright law.<span class=\"Apple-converted-space\">  <\/span>As a copyright owner, Loubie has the right to control the digital blueprint and derivative works printed from it.<span class=\"Apple-converted-space\">  <\/span>But if her digital blueprint was for a functional object like a kitchen gadget or a car door handle, the object would not be copyrightable; the design and digital blueprint, maybe.<span class=\"Apple-converted-space\">  <\/span>In any event, 3D printing objects from such designs would not be copyright infringement.<span class=\"Apple-converted-space\">  <\/span>Unless such an object was patented, it would have no IP protection and anyone would be free to copy and print it.<span class=\"Apple-converted-space\">  <\/span>It would be in the public domain.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><img decoding=\"async\" class=\"wp-image-76198 size-thumbnail alignright\" src=\"https:\/\/3dprintingindustry.com\/wp-content\/uploads\/2016\/04\/3dp_myminifactory_logo-1-150x150.jpg\" alt=\"3dp_myminifactory_logo\" width=\"100\" height=\"100\" \/><img decoding=\"async\" class=\"alignleft wp-image-66468 size-thumbnail\" src=\"https:\/\/3dprintingindustry.com\/wp-content\/uploads\/2016\/02\/makerbot-thingiverse-3D-printing-logo-1-150x150.png\" alt=\"makerbot thingiverse 3D printing logo\" width=\"100\" height=\"100\" \/>But having a copyright and having the right or ability to enforce it can be two very different things.<span class=\"Apple-converted-space\">  <\/span>By uploading a digital blueprint to a file-sharing website like Thingiverse or <span class=\"s2\">Myminifactory<\/span>, the designer usually enters into a license agreement with the website that limits his\/her copyright and grants rights to people who download and 3D print the blueprints.<span class=\"Apple-converted-space\">  <\/span>For example, under Thingiverse\u2019s <span class=\"s2\">terms of use<\/span> as they stand today, users retain IP rights to the designs they post, but they also grant Thingiverse a broad and irrevocable copyright license to include their designs on the Thingiverse platform.<span class=\"Apple-converted-space\">  <\/span>The terms also say that a user must select a secondary copyright license when uploading a design that will govern how others may use it, which may be a Creative Commons license or any other license Thingiverse makes available for selection.<span class=\"Apple-converted-space\">  <\/span>The terms also provide two options for sharing the design through third party software and websites integrated with Thingiverse and other parts of the MakerBot Ecosystem: (1) only with clear permission, or (2) automatically, with the ability to opt out.<span class=\"Apple-converted-space\">  <\/span>Not surprisingly, it is the user\u2019s responsibility to enforce this secondary license, not Thingiverse\u2019s.<span class=\"Apple-converted-space\">  <\/span>This is normal.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">How do you know if your design or object is copyrightable?<span class=\"Apple-converted-space\">  <\/span>The copyright law works in kind of a counterintuitive way.<span class=\"Apple-converted-space\">  <\/span>The only way to be sure is for a court to decide.<span class=\"Apple-converted-space\">  <\/span>But anything that CAN be copyrighted is automatically copyrighted the moment it is put into a tangible form.<span class=\"Apple-converted-space\">  <\/span>So how do you know if your design or object can be copyrighted?<span class=\"Apple-converted-space\">  <\/span>The easiest answer is to file an application to register it in the U.S. Copyright Office, which you can do yourself.<span class=\"Apple-converted-space\">  <\/span>If the Copyright Office accepts the application, your design or object is probably copyrightable, although a court could later disagree if you sue to enforce your rights.<span class=\"Apple-converted-space\">  <\/span>The US Copyright Office <span class=\"s2\">website<\/span> provides all of the information you need to register a claim.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Assuming that a design is copyrightable, the designer should carefully read the terms of the licenses she agrees to when uploading it.<span class=\"Apple-converted-space\">  <\/span>Some file-sharing sites require anyone who uploads a design to agree to a Creative Commons license, which give others permission to use, share, and build upon their designs, or specify restrictions applicable to different types of users.<span class=\"Apple-converted-space\">  <\/span>CC licenses may have a non-commercial restriction, which says that users can\u2019t sell the designs.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Depending on what license a file sharing website requires designers to agree to when they upload digital blueprints, they may or may not have any rights against a person who downloads the design, 3D prints it, and sells the objects.<span class=\"Apple-converted-space\">  <\/span>If the license gives the designer any such rights, she still may not have many options if someone violates those rights.<span class=\"Apple-converted-space\">  <\/span>Trial by public opinion may effective, which worked for Loubie.<span class=\"Apple-converted-space\">  <\/span>The offending objects disappeared from eBay and Thingiverse changed its user agreement. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><img decoding=\"async\" class=\"alignleft size-thumbnail wp-image-82152\" src=\"https:\/\/3dprintingindustry.com\/wp-content\/uploads\/2016\/06\/dmca-takedown-notice-150x100.gif\" alt=\"dmca-takedown-notice\" width=\"150\" height=\"100\" \/>If the design or object is copyrightable, the designer could also send a takedown notice to the host website under the Digital Millennium Copyright Act (DMCA).<span class=\"Apple-converted-space\">  <\/span>As a practical matter, website administrators do not have the ability to determine if a particular design or object is copyrightable or not, or if the person who claims to own it really does, so they will usually take down any design or object for which they get a takedown notice.<span class=\"Apple-converted-space\">  <\/span>Of course this procedure can be abused by the owners of functional, noncopyrightable designs, but the designers do not always know if their designs or objects are copyrightable or not.<span class=\"Apple-converted-space\">  <\/span>So designers err on the side of sending takedown notices and website administrators usually honor them.<span class=\"Apple-converted-space\">  <\/span>I have not seen much real abuse, mostly just designers who believe their designs or objects are copyrighted when they probably are not.<span class=\"Apple-converted-space\">  <\/span>The user on the receiving end of the notice, whose design or object is taken down, can send a counter-notice arguing that the design or object is not copyrightable, and let the chips fall where they may.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">File-sharing website user agreements may give users the right to download and print digital blueprints, but not to sell the designs or 3D printed objects.<span class=\"Apple-converted-space\">  <\/span>If a user sells the design or object, the designer can complain to the website that the user violated the license.<span class=\"Apple-converted-space\">  <\/span>Aside from using public opinion to shame the website into doing something about it, which worked for Loubie, designers may not always be this successful.<span class=\"Apple-converted-space\">  <\/span>The website agreement probably says that the website owner has no obligation to do anything if the user violates the agreement, except maybe to block the user\u2019s future use of the website.<span class=\"Apple-converted-space\">  <\/span>This is normal too. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">If the website user agreement allows the designer to enforce its copyrights, or if the user violates the rights that the designer granted to website users, legally enforcing these rights can be expensive and time-consuming.<span class=\"Apple-converted-space\">  <\/span>Even hiring an attorney just to threaten someone like Just3Dprint is usually costly enough to dissuade most designers from taking such a step to enforce their rights.<span class=\"Apple-converted-space\">  <\/span>For those who do choose this route, if the infringer does not capitulate, then the next step is to file a lawsuit, which is usually way too expensive for most designers.<span class=\"Apple-converted-space\">  <\/span>Although attorneys sometimes take such cases on contingency, meaning they only get paid if they win, designers are still often required to pay the costs of the litigation, which can be prohibitive, and attorneys only take such cases when the bad guy made enough money doing bad things with the design that both the client and the attorney can get a good return on investing in the case.<span class=\"Apple-converted-space\">  <\/span>There is a benefit to early copyright registration here: if the designer registers before suing, he is eligible (but not guaranteed) to recover attorneys\u2019 fees if he wins.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">All of this means that designers who make their digital blueprints available for download and 3D printing must either be willing to allow users to print and sell objects printed from the design or should be aware that their rights and their options for enforcing them may be rather narrow if someone prints and sells the design without permission.<\/span><\/p>\n<p class=\"p1\"><span
