{"id":68875,"date":"2019-07-29T13:34:04","date_gmt":"2019-07-29T05:34:04","guid":{"rendered":"http:\/\/facfox.com\/news\/aerospace\/more-3d-printing-patents-are-expiring-soon-heres-a-roundup.3dm"},"modified":"2019-07-29T13:34:04","modified_gmt":"2019-07-29T05:34:04","slug":"more-3d-printing-patents-are-expiring-soon-heres-a-roundup","status":"publish","type":"post","link":"https:\/\/facfox.com\/news\/more-3d-printing-patents-are-expiring-soon-heres-a-roundup\/","title":{"rendered":"More 3D Printing Patents Are Expiring Soon: Here\u2019s a Roundup"},"content":{"rendered":"<div id=\"dpsp-content-top\" class=\"dpsp-content-wrapper dpsp-shape-rectangular dpsp-size-medium dpsp-has-spacing dpsp-has-buttons-count dpsp-show-on-mobile dpsp-button-style-1\">\n<div class=\"dpsp-total-share-wrapper\"><span class=\"dpsp-total-share-count\">165<\/span><span>shares<\/span><\/div>\n<ul class=\"dpsp-networks-btns-wrapper dpsp-networks-btns-content dpsp-networks-btns-share dpsp-column-auto\">\n<li><span class=\"dpsp-network-icon\"><\/span><span class=\"dpsp-network-label-wrapper\"><span class=\"dpsp-network-count\">33<\/span><\/span><\/li>\n<li><span class=\"dpsp-network-icon\"><\/span><span class=\"dpsp-network-label-wrapper\"><span class=\"dpsp-network-count\">124<\/span><\/span><\/li>\n<li><span class=\"dpsp-network-icon\"><\/span><span class=\"dpsp-network-label-wrapper\"><span class=\"dpsp-network-count\">8<\/span><\/span><\/li>\n<li><span class=\"dpsp-network-icon\"><\/span><span class=\"dpsp-network-label-wrapper\"><\/span><\/li>\n<\/ul>\n<\/div>\n<p class=\"p1\"><span class=\"s1\">A few years ago, the expiration of many key 3D printing patents had the 3D printing community abuzz.<span class=\"Apple-converted-space\">  <\/span>The 3D printing patents that expired in the 2013-15 timeframe are described <span class=\"s2\">here<\/span>.<span class=\"Apple-converted-space\">  <\/span>At that time, many articles challenged the conventional wisdom that intellectual property drives innovation by creating competition, since the existence of IP forces workarounds.<span class=\"Apple-converted-space\">  <\/span>Those articles argue that patents prevented innovation in 3D printing because the fear of being sued led to a lack of investment in 3D printing R&amp;D, and that patent litigation hindered the adoption of the technology.<span class=\"Apple-converted-space\">  <\/span>The end result, some believe, is that IP creates barriers to entry for new market players, minimizes competition, and keeps prices artificially high. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"> The expiration of several key 3D printing patents in 2013, 2014, and 2015 was supposed to change the industry.<span class=\"Apple-converted-space\">  <\/span>So what happened?<span class=\"Apple-converted-space\">  <\/span>Did the expiration of those patents lead to market growth, reduction in prices, and new products?<span class=\"Apple-converted-space\">  <\/span>Or were other forces, such as the technology itself, holding back new 3D printing technologies?<span class=\"Apple-converted-space\">  <\/span>Are there other 3D printing patents that will expire soon that could have similar effects?<span class=\"Apple-converted-space\">  <\/span>Although it is still too early to give definitive answers to these questions, this article describes developments in the 3D printing industry since the expiration of some of the so-called key patents and discusses 3D printing patents that have or will expire soon.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\"><span class=\"s1\"><b>II. What\u2019s Happened Since the Demise of Key  Patents from 2013-2015?<\/b><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><span class=\"Apple-converted-space\"> <\/span>Several early vat photopolymerization (aka stereolithography or DLP) and powder bed fusion (aka selective laser sintering) patents expired between 2013-2015.<span class=\"Apple-converted-space\">  <\/span>The expired VPP patents included U.S. Patent No. 5,569,349 to Almquist et al., which expired on October 29, 2013; U.S. Patent No. 5,597,520 to Smalley et al., which expired on January 28, 2014; U.S. Patent No. 5,609,812 to Childers et al., which expired on March 11, 2014; and U.S. Patent No. 5,762,856 to Hull, which expired on June 9, 2015. <\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">The expired PBF patents included U.S. Patent No.<\/span> <span class=\"s1\">5,597,589 to Deckard, which expired on January 28, 2014; U.S. Patent No. 5, 639,070 to Deckard, which expired on June 17, 2014; and U.S. Patent No. 5,733,497 to McAlea et al., which expired on March 20, 2015.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"> New VPP-based 3D printers offered by new and established companies have emerged since the expiration of VPP patents from 2013-2015, but it is not clear that these new products and companies surfaced because patents expired.<span class=\"Apple-converted-space\">  <\/span>For example, industrial 3D printing company Carbon came into being in June 2014, and announced its first commercial product, the much-hailed Carbon M1, in April 2016.<span class=\"Apple-converted-space\">  <\/span>The Carbon M1 uses what the company calls \u201cContinuous Liquid Interface Production\u201d (CLIP), a VPP process that some say is derived from early and now-expired VPP patents owned by 3D Systems.<span class=\"Apple-converted-space\">  <\/span>But CLIP has been the subject of at least two U.S. patents filed in December 2014 and currently assigned to Carbon\u2014U.S. Patent Nos. 9,205,601 and 9,211,678.<span class=\"Apple-converted-space\">  <\/span>CLIP, at least as described and claimed in these patents, does not practice the expired VPP patents.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"> Formlabs has also released new, affordable VPP-based printers since the demise of early VPP patents during the 2013-2015 timeframe.<span class=\"Apple-converted-space\">  <\/span>These products include the Form 1+ printer, released in June 2014, and the Form 2 printer, released in September 2015.<span class=\"Apple-converted-space\">  <\/span>However, 3D Systems sued Formlabs in November 2013 alleging infringement of certain VPP patents.<span class=\"Apple-converted-space\">  <\/span>That lawsuit ultimately settled in December 2014, with Formlabs taking a license to the asserted patents and agreeing to pay 3D Systems \u201c<span class=\"s2\">a royalty of 8.0% of net sales of Formlabs products through the effective period<\/span>.\u201d<span class=\"Apple-converted-space\">  <\/span>Interestingly, all of the patents in the lawsuit are now expired, with the last one expiring on September 29, 2015, just a week after Formlabs\u2019 release of the Form 2 printer.<span class=\"Apple-converted-space\">  <\/span>Although the details of the settlement agreement were not made public, given the legal prohibition against collecting royalties on an expired patent, it is probably safe to assume that Formlabs is no longer paying 3D Systems a royalty on products that may have been covered by now-expired patents.<span class=\"Apple-converted-space\">  <\/span>It could be the case that the expiration of the VPP patents asserted by 3D Systems against Formlabs has allowed Formlabs to bring new, affordable products to market.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"> Formlabs just got sued for patent infringement again, this time by <span class=\"s2\">EnvisionTEC<\/span>.<span class=\"Apple-converted-space\">  <\/span>Because patent litigation is a fact of life for successful companies, maybe the patent heat that Formlabs is feeling means it is doing something right.<span class=\"Apple-converted-space\">  <\/span>Or maybe not.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"> New companies offering PBF 3D printers have also emerged since the demise of PBF patents from 2013-2015.<span class=\"Apple-converted-space\">  <\/span>However, as with the developments in the VPP-based market, it is unclear whether the expiration of early PBF patents caused these new companies to come into being.<span class=\"Apple-converted-space\">  <\/span>Norge Systems and Sinterit are two examples of companies that surfaced after the expiration of early PBF patents, offering low-cost PBF printers.<span class=\"Apple-converted-space\">  <\/span>Norge Systems launched a Kickstarter campaign for its Ice 1 and Ice 9 PBF printer products in August 2014.<span class=\"Apple-converted-space\">  <\/span>These products were supposed to be affordable, consumer grade PBF printers.<span class=\"Apple-converted-space\">  <\/span>That campaign, however, was unsuccessful.<span class=\"Apple-converted-space\">  <\/span>Norge never brought an affordable PBF printer to market, and was instead acquired by Prodways, perhaps indicating <img fetchpriority=\"high\" decoding=\"async\" class=\"wp-image-96563 alignright\" src=\"https:\/\/3dprintingindustry.com\/wp-content\/uploads\/2016\/10\/photodune-10802998-patent-m-300x229.jpg\" alt=\"photodune-10802998-patent-m\" width=\"401\" height=\"306\" \/>that something other than patents were preventing this technology from becoming more widespread.<span class=\"Apple-converted-space\">  <\/span>As for Sinterit, it announced the release of its first product ever, the Lisa, a low-cost PBF 3D printer earlier this summer.<span class=\"Apple-converted-space\">  <\/span>Sinterit\u2019s product has generated a lot of interest, but only time will tell if the Lisa is a success.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"> Since the expiration of VPP and PBF patents in 2013-2015, new players and products offering 3D printers using these technologies clearly have entered the market.<span class=\"Apple-converted-space\">  <\/span>What is less clear, however, is whether the demise of early 3D printing patents led to the creation of these new companies and products.<span class=\"Apple-converted-space\">  <\/span>The authors\u2019 personal opinion, based on a lot of schmoozing with industry players, is that the patent expirations played a large part in this process, just as the expiration of key Material Extrusion (aka FDM) patents seemingly caused an explosion of startups over the past few years.<span class=\"Apple-converted-space\">  <\/span>With more 3D printing patents having expired earlier this year and others expiring in the next few years, the question remains:<span class=\"Apple-converted-space\">  <\/span>Is there a reason for 3D printing startups to continue to be excited?<\/span><\/p>\n<p>III. More Patents Are Expiring<\/p>\n<p class=\"p1\"><span class=\"s1\"><b> <\/b>More 3D printing patents will expire in the coming months and years.<span class=\"Apple-converted-space\">  <\/span>Here they are, in chronological order based on expiration date, with those expiring soonest appearing first.<span class=\"Apple-converted-space\">  <\/span>Although many of these patents contain one or more inventions, the following is intended to provide a general description of some of the claimed subject matter in each patent.<span class=\"Apple-converted-space\">  <\/span>The metes and bounds of each patent is defined by its claims, so don\u2019t rely only on these general descriptions.<span class=\"Apple-converted-space\">  <\/span>Warning: these patent descriptions are written in a language similar to English, called \u201cpatentese,\u201d so they may be a bit dense for the layperson.<span class=\"Apple-converted-space\">  <\/span>Another warning:<span class=\"Apple-converted-space\">  <\/span>the expiration dates given below could be affected by a variety of legal factors.<span class=\"Apple-converted-space\">  <\/span>To be sure a particular patent has expired, ask a patent attorney.<\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">U.S. Patent No. 5,817,206 &#8211; <\/span><span class=\"s4\">Expired February 7, 2016<\/span><\/p>\n<p class=\"p4\"><span class=\"s4\">Assigned to DTM<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"> U.S. Patent No. 5,817,206 to McAlea et al. entitled \u201cSelective Laser Sintering of Polymer Powder of Controlled Particle Size Distribution,\u201d covers a method for fabricating a 3D article.<span class=\"Apple-converted-space\">  <\/span>The method comprises dispensing a layer of powder consisting essentially of substantially spherical polymer particles having a mean volume diameter of between 20-50 microns at a target surface, where less than about 5% of the volume fraction of the powder consists of particles having a diameter of less than 15 microns.<span class=\"Apple-converted-space\">  <\/span>Selected locations of the layer of powder are fused in a mass.<span class=\"Apple-converted-space\">  <\/span>The dispensing and fusing steps are repeated for two or more layers, with fused portions of successive layers fusing to portions of the immediately prior layer to form the article.<span class=\"Apple-converted-space\">   <\/span><\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">U.S. Patent No. 5,753,274 &#8211; <\/span><span class=\"s4\">Expired March 26, 2016<\/span><\/p>\n<p class=\"p4\"><span class=\"s4\">Assigned to EOS GmbH Electro-Optical Systems<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"> U.S. Patent No. 5,753,274 to Wilkening and Lohner entitled \u201cApparatus for Producing a Three-Dimensional Object,\u201d covers an apparatus for producing a 3D object by successive solidification of layers of a powder material at cross sections of the object using radiation.<span class=\"Apple-converted-space\">  <\/span>The apparatus comprises an opening defined by peripheral walls that have a top surface, a support with an upper surface that supports the object in the opening, elevation adjustment means for varying the elevation of the support\u2019s upper surface, means for applying a layer of powder material on the support\u2019s upper surface or on a solidified layer of powder material formed on the support\u2019s upper surface, and irradiation means positioned over the top surface of the peripheral walls for irradiating the solidified layers of powdered material at cross sections of the object.<span class=\"Apple-converted-space\">  <\/span>The support also has a removable base plate comprised of a presolidified amount of powder material.<span class=\"Apple-converted-space\">  <\/span>The upper surface of the support is on the removable base plate.<span class=\"Apple-converted-space\">  <\/span>The elevation means positions the upper surface of the support or a solidified layer of powder material formed on the support\u2019s upper surface below the top surface of the peripheral walls by an amount equal to the layer of powder material to be applied.<span class=\"Apple-converted-space\">  <\/span>In contrast to sintering approaches that require complete solidification of one or more initial powder layers using a laser, the use of a removal base plate comprised of a presolidified amount of powder material reduces production time for 3D objects.<\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">U.S. Patent No. 6,007,318 &#8211; <\/span><span class=\"s4\">Expiring December 20, 2016<\/span><\/p>\n<p class=\"p4\"><span class=\"s4\">Assigned to Z-Corp<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"> U.S. Patent No. 6,007,318 to Russel et al. entitled \u201cMethod and Apparatus for Prototyping a 3D object,\u201d covers apparatuses for fabricating a 3D object from a representation of the object stored in a memory.<span class=\"Apple-converted-space\">  <\/span>The apparatus comprises a feed reservoir that stores a supply of build material for forming the object, a build table that receives incremental layers of the build material from the feed reservoir, an overflow cavity for receiving an excess quantity of build material transferred from the feed reservoir but not received by the build table, and a vacuum pump coupled to the overflow cavity to create an air flow from the overflow cavity. <\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">U.S. Patent No. 5,866,058 &#8211; <\/span><span class=\"s4\">Expiring May 29, 2017<\/span><\/p>\n<p class=\"p4\"><span class=\"s4\">Assigned to Stratasys<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"> U.S. Patent No. 5,866,058 to Batchelder et al. entitled \u201cMethod for Rapid Prototyping of Solid Models,\u201d covers a method for making a 3D object of a predetermined shape under control of a control system.<span class=\"Apple-converted-space\">  <\/span>The method uses a thermally solidifiable material having a solidification temperature and a creep relaxation temperature.<span class=\"Apple-converted-space\">  <\/span>The method comprises dispensing the thermally solidifiable material in a fluid state from an extruder into a build region that has a local region temperature exceeding the solidification temperature of the thermally solidifiable material and simultaneously generating relative movement between the extruder and a support in the build region, so that the thermally solidifiable material accumulates on the support to form a 3D object.<span class=\"Apple-converted-space\">  <\/span>The method also involves solidifying the thermally solidifiable material by cooling the local region temperature of the build region and the thermally solidifiable material below the solidification temperature of the thermally solidifiable material.<span class=\"Apple-converted-space\">  <\/span>The use of thermally solidifiable material may achieve reductions in internal stresses of the resulting 3D object.<\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">U.S. Patent No. 6,085,122 &#8211; <\/span><span class=\"s4\">Expiring May 30, 2017<\/span><\/p>\n<p class=\"p4\"><span class=\"s4\">Assigned to DTM<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"> U.S. Patent No. 6,085,122 to Manning entitled \u201cEnd-of-Vector Laser Power Control in a Selective Laser Sintering System,\u201d covers selective laser sintering apparatuses and methods.<span class=\"Apple-converted-space\">  <\/span>The apparatus comprises a powder delivery system that applies successive layers of powder at a target surface; a laser that generates a laser beam; a scanning system that scans the laser beam across the target surface along a vector; and a laser power control system.<span class=\"Apple-converted-space\">  <\/span>The laser power control system has an output coupled to the laser, an input coupled to the scanning system to receive a control signal indicating the operation of the scanning system in directing the laser at the target surface, an input for receiving a desired laser power signal indicating a desired laser power level, and an input for receiving a laser on\/off signal indicating when the laser is to be turned on and off.<span class=\"Apple-converted-space\">  <\/span>The laser power control system produces, at its output, a laser power signal corresponding to the product of the desired laser power level with a scan velocity based on the control signal.<span class=\"Apple-converted-space\">  <\/span>The laser power control system also comprises a gate, coupled to receive the control signal, and a control terminal coupled to receive the laser on\/off signal that selectively passes and blocks the control signal responsive to the laser on\/off signal; and a multiplier, coupled to receive the control signal from the gate and to receive the desired laser power signal that generates the laser power signal corresponding to the product of the gated control signal and the desired laser power signal.<\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">U.S. Patent No. 6,215,093 &#8211; <\/span><span class=\"s4\">Expiring October 27, 2017<\/span><\/p>\n<p class=\"p4\"><span class=\"s4\">Assigned to Fraunhofer-<\/span> <span class=\"s4\">Gesellschaft Zur Foerderung der Angewandten Forschung E.V.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"> U.S. Patent No. 6,215,093 to Meiners et al. entitled \u201cSelective Laser Sintering at Melting Temperature,\u201d discloses a method for manufacturing a molded body, particularly a prototype of a product or component, a tool prototype, or spare part using three-dimensional CAD data of a model of a molded body by depositing layers of a metallic material in powder form.<span class=\"Apple-converted-space\">  <\/span>Several layers of the powder are successively deposited one on top of the other, and each layer of powder is heated to a specified temperature by means of a focused laser beam applied to a given area corresponding to a selected cross-sectional area of the model of the molded body before depositing the next layer.<span class=\"Apple-converted-space\">  <\/span>The laser beam is guided over each layer of powder using the CAD cross-sectional data of the selected cross-sectional area of the model in such a way that each layer of powder is fixed to the layer below.<span class=\"Apple-converted-space\">  <\/span>The improvement of the method lies in the fact that the metallic material in powder form is applied in the form of a metallic powder free of binding and fluxing agents, and it is heated by the laser beam to melting temperature.<span class=\"Apple-converted-space\">  <\/span>The energy of the laser beam is chosen in such a way that the layer of metallic powder is fully molten throughout its layer thickness at the point of impact of said laser beam, and the laser beam is guided across the specified area of powder in several runs in such a way that each run of the laser beam partly overlaps the preceding run.<span class=\"Apple-converted-space\">  <\/span>A protective gas atmosphere is maintained above the interaction zone of the laser beam and the metallic powder.<\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">U.S. Patent No. 6,004,124 &#8211; <\/span><span class=\"s4\">Expiring January 26, 2018<\/span><\/p>\n<p class=\"p4\"><span class=\"s4\">Assigned to Stratasys<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"> U.S. Patent No. 6,004,124 to Swanson et al., entitled \u201cThin-Wall Tube Liquifier,\u201d covers an extrusion head for depositing layers of solidifying material in a desired pattern to form 3D objects.<span class=\"Apple-converted-space\">  <\/span>The extrusion head comprises a heating block made of heat conductive material; a heating element to heat the heating block; and a thin walled tube having an inlet end for receiving a filament of a first material, an outlet end for delivering the first material in a molten state, and a first section adjacent the inlet end and exterior to the heating block and a second section which passes through the heating block.<span class=\"Apple-converted-space\">  <\/span>The extrusion head further comprises <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">a material advance mechanism positioned to advance the filament of first material into the inlet end of the first thin-wall tube; and a nozzle at the outlet end of the first thin-wall tube for dispensing the first material in a molten state.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b><br \/>\nIV. Conclusion<\/b><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b> <\/b>As with the expiration of 3D printing patents from 2013-2015, only time will tell how these patents affect the 3D printing industry.<span class=\"Apple-converted-space\">  <\/span>Other forces, such as new legal developments, evolving technology, and the economy, could have a greater impact.<span class=\"Apple-converted-space\">  <\/span>We\u2019ll just have to wait and see what happens next.<\/span><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>165shares 33 124 8 A few years ago, the expiration of many key 3D printing patents had the 3D printing community abuzz.
